INTRODUCTION & AGREEMENT TO TERMS
Welcome to Tezkar Sports (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our e-commerce platform located at www.tezkarsports.com and all related services, features, and sales of sports promotional products, custom merchandise, team apparel, and corporate athletic gear (collectively, “Products”).
By placing an order, registering an account, or browsing our website, you (“Customer,” “Client,” or “User”) agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the website and refrained from ordering Products.
ELIGIBILITY & ACCOUNT REGISTRATION
To purchase Products from Tezkar Sports, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the legal authority to enter into binding contracts. When creating an account, you agree to:
- Provide accurate, current, and complete account, billing, and contact details.
- Maintain and promptly update your account information.
- Maintain the confidentiality of your account password and restrict access to your computer or devices.
- Accept full responsibility for all activities that occur under your user account.
PRODUCT ORDERING & CUSTOMIZATION PROCESS
Tezkar Sports specializes in customized sports promotional merchandise (including branded jerseys, custom balls, drinkware, athletic bags, and event giveaways). All orders are subject to acceptance and stock availability.
- Digital Proofing & Approval: For customized items, Tezkar Sports will issue a digital proof (e.g., PDF or high- resolution graphic) detailing design, placement, sizing, and color codes (PMS/Pantone). Production begins only after formal written or digital approval from the Customer.
- Customer Responsibility: The Customer is solely responsible for reviewing and verifying all artwork, spelling, graphics, logo alignment, and dimensions prior to approval. Tezkar Sports is not liable for errors present in customer- approved proofs.
- Color Matching: While we utilize industry-standard color matching systems (Pantone Matching System), slight variances may occur depending on fabric, material texture, and print method (e.g., sublimation, screen printing, embroidery, laser engraving). Exact color matching cannot be guaranteed.
PRODUCTION TIMES, SHIPPING & DELIVERY
Production turnarounds and delivery times are estimates and do not constitute guaranteed arrival dates:
- Standard Lead Times: Custom sports promotional merchandise generally requires a standard production timeframe of 7 to 14 business days following proof approval and payment receipt. Express/rush options may be available upon request for an additional fee.
- Shipping & Risk of Loss: Delivery is executed via third-party freight or courier carriers. Risk of loss and title to Products pass to the Customer upon transfer to the freight carrier.
- Delays: Tezkar Sports is not liable for shipping delays caused by carrier disruptions, weather events, customs delays, or incorrect delivery address information supplied by the Customer.
CANCELLATIONS, RETURNS & REFUND POLICY
Due to the bespoke nature of customized athletic and promotional gear, our cancellation and return policy operates as follows:
- Custom/Personalized Orders: Once a digital proof is approved and production has commenced, custom orders cannot be cancelled, returned, or refunded except in cases of manufacturing defects or printer errors deviating significantly from the approved proof.
- Defective or Damaged Goods: Claims regarding damaged, missing, or materially defective Products must be submitted in writing to sales@tezkarsports.com within 7 calendar days of order receipt, accompanied by high-resolution photographs of the issue.
- Blank/Stock Items: Unprinted stock products may be returned within 14 days of receipt, subject to a 15% restocking fee. Return shipping costs are the responsibility of the Customer.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Tezkar Sports shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profit, loss of event sponsorship, or business interruption)arising out of or related to the purchase or use of our Products or services, even if advised of the possibility of such damages. In no event shall Tezkar Sports’ total aggregate liability exceed the total purchase price paid by the Customer for the specific order giving rise to the claim.
